These Terms of Service (the "Terms") set out the conditions governing use of The Japan Butler Academy website (the "Website") operated by The All Japan Butler Association (the "Association") and related services provided through the Website (the "Services"). All persons who use the Website are deemed to have agreed to these Terms.
Scope of Application
These Terms apply between the Association and users (the "Users") in relation to the use of The Japan Butler Academy website (the "Website") operated by the Association and related services provided through the Website (the "Services").
By using the Website, Users are deemed to have agreed to these Terms. If you do not agree to these Terms, please refrain from using the Website.
Definitions
Terms used in these Terms are defined as follows.
"Website" means The Japan Butler Academy website (https://butler-academy.jp) operated by the Association.
"Services" means the information provision, brochure requests, individual consultation bookings, application processing, enquiry handling, and other services provided through the Website.
"Student" means a person enrolled in a course provided by the Association.
"User" means any person who browses or uses the Website.
Use of the Website
Users shall use the Website at their own responsibility.
The Association accepts no responsibility for devices, software, or communication environments required to use the Website.
The Association may, without prior notice to Users, modify the content of the Website or suspend or discontinue its operation.
Any disputes arising between Users, or between a User and a third party, in connection with the use of the Website shall be resolved by the User at their own responsibility and expense. The Association accepts no responsibility in such cases.
Intellectual Property Rights
Copyright, trademark rights, and all other intellectual property rights in text, images, video, logos, educational materials, designs, programmes, and all other content (the "Content") published on the Website belong to the Association or to third parties holding legitimate rights.
Users may not reproduce, republish, modify, adapt, publicly transmit, distribute, lend, translate, sell, or otherwise use the Content without the prior written consent of the Association, regardless of the method.
If any dispute arises with a third party as a result of a breach of this Article, the User shall resolve such dispute at their own responsibility and expense and shall compensate the Association for any resulting damage.
Prohibited Conduct
Users must not engage in the following conduct when using the Website.
(1) Acts that violate laws or public order and morals
(2) Acts that infringe the rights (including intellectual property rights, reputation, and privacy) of the Association or third parties
(3) Acts of impersonating other Users, third parties, or the Association
(4) Acts that interfere with the operation of the Website (including mass access and transmission of malicious programs)
(5) Acts that damage the reputation of the Association
(6) Collection or use of information for commercial purposes
(7) Any other conduct deemed inappropriate by the Association
Where a User violates this Article, the Association may suspend that User's access to the Website or take other appropriate measures.
Relationship with Enrolment Agreements
These Terms set out the conditions governing use of the Website and Services and do not govern the enrolment agreement for courses.
Conditions relating to course enrolment, attendance, cancellation, and refunds are governed by the separately issued Prospectus and Enrolment Agreement. For details, please refer to the Application Requirements & Enrolment Process page (/application).
In the event of any inconsistency between these Terms and the Enrolment Agreement, the Enrolment Agreement shall take precedence.
Disclaimer
While the Association takes great care regarding the accuracy, currency, and usefulness of information published on the Website, it does not guarantee completeness.
The Association accepts no responsibility for any damage (including indirect damage, special damage, or lost profits) arising from the use of the Website, except where caused by the Association's wilful misconduct or gross negligence.
The Association accepts no responsibility for the content of third-party websites linked from the Website.
The Association may temporarily suspend the provision of Services due to natural disasters, line failures, equipment faults, maintenance, or other unavoidable circumstances, and accepts no responsibility for any resulting damage to Users, except where caused by wilful misconduct or gross negligence.
Changes and Suspension of Services
The Association may, without prior notice to Users, modify, add to, or discontinue the content of the Services.
The Association may temporarily suspend all or part of the Services in any of the following circumstances.
(1) When performing maintenance or inspection of the Website
(2) When provision of the Services is rendered difficult due to natural disasters, power outages, communication line failures, or other unforeseen circumstances
(3) In any other case where the Association determines that a temporary suspension is necessary for operational or technical reasons
Even where damage is caused to Users by modifications or suspensions under the preceding paragraph, the Association accepts no responsibility, except where caused by wilful misconduct or gross negligence.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising between the Association and Users in connection with the Services.
Amendments to the Terms
The Association may amend these Terms in the following circumstances.
(1) Where the amendment is in the general interest of Users
(2) Where the amendment is not contrary to the purpose of the agreement, and is reasonable having regard to the necessity of the change, the appropriateness of the amended content, and other relevant circumstances
Where these Terms are amended, the Association will notify Users by publishing the amended Terms and the date on which they take effect on the Website. In the case of significant changes, registered enquirers and enrolled students may be notified individually by email or other means.
Continued use of the Website after the effective date of any amended Terms shall be deemed to constitute the User's acceptance of the amended Terms.
Conditions relating to course enrolment, attendance, cancellation, and refunds are governed not by these Terms but by the separately issued Prospectus and Enrolment Agreement. For details, please refer to theApplication Requirements & Enrolment Processpage.
These Terms may be revised without prior notice. In the event of significant changes, registered enquirers and enrolled students will be notified individually.
